NYC building compliance deadlines:
every law, one calendar.

Five laws set the dates, and most of them repeat. Local Law 84 benchmarking and the Local Law 97 emissions report are both due May 1 every year; the Local Law 33 energy grade is issued October 1 and must be posted within 30 days; the Local Law 87 audit report is due December 31 of the year that matches the last digit of your tax block. Local Law 88's dates were one-time and have passed. Below: one table per law, then every date in order.

NYC building compliance deadlines at a glance

The recurring dates are few. Local Law 84 benchmarking is due May 1 every year (NYC Admin Code §28-309.4 (as amended by LL133/2016)), and so is the Local Law 97 emissions report (NYC Admin Code §28-320.3.7; 1 RCNY §103-14(b)). The Local Law 33 energy grade label is issued October 1 and must be displayed within 30 days (NYC Admin Code §28-309.12.3; 1 RCNY §103-06(l)(2)). The Local Law 87 Energy Efficiency Report is due once every ten years, by December 31 of the calendar year whose last digit matches the building's tax block (NYC Admin Code §28-308.4, §28-308.4.1). Local Law 88's lighting and sub-metering deadlines were fixed dates in 2025 (NYC Admin Code §28-310.3, §28-311.3).

One thing to plan around: the extensions DOB issued by service notice in 2025 — benchmarking to June 30, LL97 to December 31, the energy grade to December 31, LL87 to March 31, 2026 — were one-time. DOB has said that in filing year 2026 every report is due on its statutory date and that the 2025 extensions do not apply (DOB Service Notice 2/27/2026). Each law below gets its own table, with recurring and one-time dates marked as such; the last section puts every upcoming date in one chronological list. Local Law 84 benchmarking deadlines

Local Law 84 covers, as the building appears in Department of Finance records, a building that exceeds 25,000 gross square feet, two or more buildings on the same tax lot that together exceed 100,000 sq ft, two or more condominium buildings under one board that together exceed 100,000 sq ft, and city buildings; the single-building threshold was 50,000 sq ft until Local Law 133 of 2016 lowered it (NYC Admin Code §28-309.2 (as amended by LL133/2016); DOB LL84 Benchmarking Law page). The obligation is an annual benchmark in ENERGY STAR Portfolio Manager — the mechanics are in the Local Law 84 guide.

June 30, 2025 — one-timeFor the 2025 filing year only, the calendar-year 2024 deadline moved from May 1 to June 30, 2025 because of the new LL97 reporting portal, and under DOB's April 21, 2025 notice an approved LL97 extension (then running to August 29, 2025) carried the benchmarking deadline with it (DOB Service Notice 4/21/2025); DOB later moved the LL97 date itself to December 31, 2025 on applications made by August 29 (DOB Service Notice 6/16/2025). It did not carry into 2026 (DOB Service Notice 2/27/2026).

Local Law 33 energy grade posting deadline

The energy grade rides on benchmarking. Buildings over 25,000 square feet — or two or more buildings on one tax lot, or under one condominium board, that together exceed 100,000 gross square feet — that appear on the NYC Benchmarking Covered Buildings List must post the Building Energy Efficiency Rating Label (NYC Admin Code §28-309.2 (as amended by LL133/2016), §28-309.12; DOB Service Notice 11/25/2025). The grade comes from the ENERGY STAR score: A at 85 or higher, B at 70–84, C at 55–69, D below 55, F where required benchmarking was not submitted, and N where a score is not feasible (NYC Admin Code §28-309.12.1 (as amended by LL95/2019); DOB LL33 Energy Grading page)— so a missed LL84 filing shows up at the front door as an F. The statute frames the clock as 30 days after the owner obtains the grade (NYC Admin Code §28-309.12.3 (LL33/2018)). DOB states that N-grade buildings are not subject to the posting requirement (DOB LL33 FAQs); the statute's own exception is narrower and covers the score of an N-graded building (NYC Admin Code §28-309.12.3 Exception).
October 1–31, 2026 — this yearDOB confirmed the 2026 window: post starting October 1 and no later than October 31, 2026 (DOB Service Notice 2/27/2026; 1 RCNY §103-06(l)(2)).

Which year is my Local Law 87 energy audit due?

Local Law 87 is the one law on this page that does not run annually. It covers buildings greater than 50,000 gross square feet, a tax lot with two or more buildings that together exceed 100,000 sq ft, and two or more condominium buildings that together exceed 100,000 sq ft (NYC Admin Code §28-308.1; DOB LL87 page). Each covered building files an Energy Efficiency Report — an energy audit plus retro-commissioning — once every ten years, between January 1 and December 31 of the calendar year whose last digit matches the last digit of its tax block number (NYC Admin Code §28-308.4, §28-308.4.1 (LL87/2009); DOB LL87 page). What goes into the report is in the Local Law 87 guide.

Local Law 87 energy audit dates

December 31, 2027 and 2028 — blocks ending in 7 and 8The statute's chart assigned blocks ending in 6, 7 and 8 to 2016, 2017 and 2018, and the report recurs every tenth calendar year — so 7 falls in 2027 and 8 in 2028 (NYC Admin Code §28-308.4.1 chart; §28-308.4 (every tenth year)). Those two years follow from the statute rather than from a DOB notice.

PenaltyFailure to submit an acceptable EER is a Major (Class 2) violation: $3,000 in the first year and $5,000 for each additional year until it is filed, and DOB will not accept an EER while penalties are outstanding (1 RCNY §103-07(n); DOB LL87 Violations page).
March 31, 2026 — one-timeBuildings due in 2025 (tax blocks ending in 5) had their December 31, 2025 deadline moved to March 31, 2026, for the 2025 filing year only (DOB Service Notice 11/25/2025).

Local Law 88 lighting and sub-metering deadlines

Local Law 88's dates are one-time and have passed, but the reporting obligation persists until it is met. It covers a building over 25,000 gross square feet, two or more buildings on the same tax lot together over 100,000 sq ft, or condominium buildings under one board together over 100,000 sq ft; the single-building threshold was lowered from 50,000 to 25,000 gross square feet by Local Law 134 of 2016 (§28-310.2, lighting) and Local Law 132 of 2016 (§28-311.2, sub-metering), and LL132 also lowered the covered-tenant-space line from 10,000 to 5,000 gross square feet (NYC Admin Code §28-310.2 (as amended by LL134/2016), §28-311.2 (as amended by LL132/2016); DOB LL88 page). January 1, 2025 — one-timeLighting systems in covered buildings had to comply with the NYC Energy Conservation Code standards for new systems, and the electrical consumption of each covered tenant space had to be measured by sub-meters (NYC Admin Code §28-310.3, §28-311.3; DOB LL88 page).

June 30, 2026 — grace periodDOB's LL88 page lists a May 1 due date with a grace period to June 30 and, where the owner is also subject to LL97, an extension to December 31 if requested by August 29 (DOB LL88 page (Filing Dates)); DOB's April 2026 processing FAQ (Q7) likewise lists June 30, 2026 (DOB Processing FAQs (Apr. 2026) Q7). The February 2026 notice states that 2025 extensions do not apply to 2026, and the LL97 extension it describes runs only to August 29, 2026 (DOB Service Notice 2/27/2026). Treat May 1 as the rule deadline and June 30 as administrative practice, and do not plan on any LL88-only extension in 2026.
Penalty$1,500 for failing to file the lighting-upgrade report and $1,500 for failing to file the sub-meter report, each assessed annually until the report is filed, plus $500 for each covered tenant space without a required sub-meter (1 RCNY §103-18(c),(e)).

What the rule does not say is a fixed 2027 date for owners still out of compliance: the report penalty simply recurs each year until the report is filed (1 RCNY §103-18(c),(e)).

Local Law 97 emissions report deadlines

Local Law 97 covers a building that exceeds 25,000 gross square feet, two or more buildings on the same tax lot that together exceed 50,000 sq ft, and two or more condominium buildings under one board that together exceed 50,000 sq ft, subject to exceptions (NYC Admin Code §28-320.1 (LL97/2019); DOB LL97 Greenhouse Gas Emissions Reductions page). Reports go through the BEAM portal, which opened March 3, 2025; filing, extension and adjustment fees are paid in DOB NOW: Safety and the payment confirmation number is entered in BEAM (DOB Service Notice 3/3/2025). For the CY2024 and CY2025 reports only, an owner could elect the statutory occupancy-group limit (§28-320.3.1, e.g. Group B 0.00846) where it exceeded the ESPM property-type factor (e.g. Office 0.00758), without mixing methods in one report; from the CY2026 report onward the ESPM factors in 1 RCNY §103-14(c)(3) govern (1 RCNY §103-14(c)(3)(ii); DOB Service Notice 2/7/2023; DOB LL97 Buildings Emissions Limits page). Local Law 97 annual reporting dates

The extension fee is $60 (1 RCNY §101-03).

Local Law 97 one-time and deferred dates
December 31, 2024 — Article 321, one-timeOwners on the prescriptive route had to ensure the required energy conservation measures were implemented where applicable (NYC Admin Code §28-321.2.2 (LL97/2019); 1 RCNY §103-17(e)(2)).

The next eighteen months, in order. Recurring dates carry the citation to the standing rule; where DOB has confirmed a specific year's date by notice, that notice is cited too. The 2025 service-notice extensions are not repeated here because DOB has said they do not apply (DOB Service Notice 2/27/2026).

Already passed in filing year 2026: benchmarking and the LL97 report on May 1, 2026; the LL97 60-day grace period and the extension application window on June 30, 2026; the extended LL97 deadline on August 29, 2026; and the LL88 catch-up report on May 1, 2026 (DOB Service Notice 2/27/2026). LL87 filers on the 2025 schedule had until March 31, 2026 (DOB Service Notice 11/25/2025). A missed 2026 benchmark can still be brought current at the quarterly dates below (DOB Benchmarking page; 1 RCNY §103-06(l)(1)).

Two things this list cannot yet show. The 2027 dates rest on the statute and the rules as written; where DOB confirms them by notice, as it did for 2026, that notice will govern. And Local Law 88 has no fixed 2027 date for owners still out of compliance — the report penalty is assessed annually until the report is filed (1 RCNY §103-18(c),(e)).

Common questions

When is the NYC benchmarking (Local Law 84) deadline?

May 1 every year, covering the previous calendar year (NYC Admin Code §28-309.4, as amended by LL133/2016). The 2026 cycle covered calendar-year 2025 energy and water data and was due May 1, 2026 (DOB LL84 Benchmarking Law page; DOB Service Notice 2/27/2026); the next is May 1, 2027. Missing May 1 may bring a $500 penalty, with another $500 for each additional quarterly violation at DOB's August 1, November 1 and February 1 catch-up dates (1 RCNY §103-06(l)(1); DOB Benchmarking page) — DOB's benchmarking page describes this as up to $2,000 per year.

Is there a grace period for Local Law 97 reports?

Yes. Reports are due May 1, but an owner is not liable for the failure-to-file penalty if a report demonstrating compliance is filed within 60 days — by June 30 (NYC Admin Code §28-320.6.2; 1 RCNY §103-14(g)). Owners can also apply, no earlier than 30 days before and no later than 60 days after May 1, for an extension that takes the deadline 120 days out to August 29 (1 RCNY §103-14(g)(2)); for the 2026 cycle DOB confirmed June 30 and August 29, 2026 (DOB Service Notice 2/27/2026). Past those dates, the late-filing penalty is up to $0.50 per gross square foot per month, for at most 12 months counted from May 1 (§28-320.6.2; 1 RCNY §103-14(g)(1)).

When do I have to post my building's energy efficiency grade?

DOB issues the Building Energy Efficiency Rating label every year on October 1, and it must be displayed near each public entrance within 30 days — by October 31 — until October 1 of the following year (NYC Admin Code §28-309.12.3; 1 RCNY §103-06(l)(2); DOB LL33 Energy Grading page). For 2026 the window is October 1 to October 31, 2026 (DOB Service Notice 2/27/2026). Failing to post carries a $1,250 penalty (1 RCNY §103-06(l)(2)). In 2025 only, the window was moved to December 1–31 (DOB Service Notice 11/25/2025).

How do I know which year my Local Law 87 energy audit is due?

What were the Local Law 88 lighting and sub-metering deadlines?

Lighting in covered buildings had to meet the NYC Energy Conservation Code standards for new systems, and every covered tenant space had to be sub-metered, by January 1, 2025 (NYC Admin Code §28-310.3, §28-311.3; DOB LL88 page). When do rent-regulated and affordable buildings first have to report under Local Law 97?

Buildings with more than 35% rent-regulated units, HDFC co-ops, buildings with project-based federal housing units, and buildings more than half used for worship follow Article 321 and owed a one-time report by May 1, 2025 (NYC Admin Code §28-321.1 as amended by LL147/2019 and LL116/2020, §28-321.3; DOB Article 321 Filing Guide rev. 4/28/2025). Buildings with at least one but not more than 35% rent-regulated units have emissions limits from January 1, 2026 and file their first annual report by May 1, 2027 (§28-320.3.10.1, LL116/2020; 1 RCNY §103-14(b)(8)(i)). Mitchell-Lama buildings, and buildings containing at least one income-restricted unit, are exempt from the 2024–2034 limits and become subject to the annual limits from January 1, 2035 (§28-320.3.9, as amended by LL147/2019); their first report is due May 1, 2036 (1 RCNY §103-14(b)(8)(ii)–(iii)).
